Privacy Policy Statement

Professional Associations Superannuation Limited (PASL) is committed to treating members' information as confidential, and as Trustee of Professional Associations Superannuation Fund or any other funds, (the Funds) has an obligation to comply with all relevant State and Federal legislation with regard to the management and administration of the Funds.

This includes the Privacy Amendment (Private Sector) Act 2000, which:

  1. amends the Privacy Act 1988 (the "Act") broadening its ambit to protect the privacy of personal information held by organisations in the private sector; and
  2. regulates the appropriate collection, holding, use, correction, disclosure and transfer of personal information by private sector organisations.

The Act applies to PASL because it holds personal information about each member of the Funds. The Trustee will be bound and will ensure that it complies with, the ten National Privacy Principles which are prescribed in the Act.

Some exemptions to the law apply, for example where the Trustee obtains information from an employer via employee records for the purposes of complying with its superannuation obligations.

The information held by PASL includes a member's personal particulars, Tax File Number, contact details, nominated beneficiaries, nominated rollover institutions, membership and contribution history, salary details, level of death and disablement insurance cover and surcharge debts. This information may be collected directly from the member or the member's employer. Medical information will also be held if a member has sought non-automatic insurance cover through the Funds and/or has lodged a claim under their Total and Permanent Disablement or Income Protection insurance cover.

Personal information about members is held and used for the purposes of establishing their membership, administration of their superannuation entitlements (including the collection of contributions) the securing of optional insurance cover and the calculation and eventual payment or transfer of a benefit.

PASL utilises the services of Primary Superannuation Services Pty Ltd, a specialist administration company which administer the Funds. Accordingly, the administration company receive, process, store and manage members' information on PASL's behalf accordingly. A PASL member's information may also be disclosed by the Trustee through the administration company, to third parties such as the Funds' insurers, actuaries, medical consultants, professional advisers, mail houses and other external service providers who are contracted for the purpose of administering, managing and marketing the Funds. The Funds must also provide information to government agencies such as the Australian Securities Investment Commission, Australian Prudential Regulation Authority, Australian Taxation Office and Superannuation Complaints Tribunal where expressly required by law.

Sensitive information such as medical and health information is not collected, used or disclosed without members' express consent. The forms collecting that information will provide details about how sensitive information may be used or disclosed.

Otherwise, Member information is kept confidential and is only disclosed to the member or their authorised representative. A member has certain rights including the right to access and correct personal information and the right to complain about any breaches of the Privacy Act 1988.

We dispose of personal information with care, either shredding it or sending it for recycling where it continues to be treated as confidential.

PASL retains the right to charge members a reasonable fee for the provision of personal information about them to cover its costs. Members' request for access will be answered within a month of receipt. If members request access to sensitive rather than personal information, there may be a delay in providing this information depending on the circumstances.

If after raising a concern about privacy with PASL, a member feels that the matter has not been dealt with adequately, then they may seek to contact the Privacy Commissioner.
